The rules and guidelines for using ClassNest

1. Acceptance of Terms
By accessing or using ClassNest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms are governed by the laws of the Republic of South Africa.
2. Description of Service
ClassNest is a daycare management platform that provides tools for managing child enrolment, attendance tracking, invoicing, billing, and parent communication. The Service is designed for daycare facilities operating in South Africa.
3. Account Registration
To use ClassNest, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised access
4. Acceptable Use
You agree to use ClassNest only for lawful purposes and in accordance with these terms. You may not:
- Use the Service for any illegal or unauthorised purpose
- Attempt to gain unauthorised access to any part of the Service
- Upload malicious code or interfere with the Service's functionality
- Share your account credentials with unauthorised persons
- Use the Service to store or process data unrelated to daycare management
5. Data Responsibility
As a daycare administrator, you are the responsible party for the personal information of children and parents stored in ClassNest, as defined under POPIA. You agree to:
- Obtain appropriate consent from parents or guardians before entering their data
- Ensure the accuracy of information entered into the system
- Use the data only for legitimate daycare management purposes
- Comply with POPIA and all applicable data protection laws
6. Subscriptions and Payments
Subscription Plans
ClassNest offers subscription plans with a free trial period. After the trial ends, continued access requires an active paid subscription. Plan details, pricing, and features are displayed on the account page at the time of purchase.
Payment Processing
Subscription payments are processed by PayFast (Pty) Ltd, a third-party payment gateway. By subscribing, you also agree to PayFast's Terms of Service. ClassNest does not store your credit card or banking details — all payment information is handled securely by PayFast.
Recurring Billing
Subscriptions are billed on a recurring monthly basis. PayFast will charge the applicable subscription fee to your chosen payment method each billing cycle. You will receive confirmation of each payment from PayFast.
Cancellation
You may cancel your subscription at any time from the account page. Upon cancellation, your subscription remains active until the end of the current billing period. After that, your account will transition to read-only mode — you can still view your data but will not be able to create or modify records.
Refunds
Subscription fees are non-refundable. If you cancel mid-cycle, you retain access until the end of the paid period. No partial refunds are issued for unused time.
Invoicing Tools
ClassNest provides invoicing tools to help you manage billing for your daycare. You are solely responsible for the accuracy of invoices generated and the collection of payments from parents. ClassNest is not liable for any billing disputes between you and parents.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime in advance.
8. Intellectual Property
The ClassNest platform, including its design, code, features, and branding, is the intellectual property of ClassNest. You retain ownership of all data you enter into the platform. We do not claim any rights to your content.
9. Limitation of Liability
To the maximum extent permitted by South African law, ClassNest shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.
10. Termination
You may delete your account at any time from the account page. If you have an active subscription, it will be cancelled automatically upon account deletion. We will retain your data for 30 days after deletion to allow for recovery, after which it will be permanently deleted. We may suspend or terminate your access if you violate these terms.
11. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of the Western Cape, South Africa.
